Q: Does it easily remain in upright stance?

It does topple fairly easily if disturbed. However, the amazing detail & quality far outweighs any minor issues w/ upright stability. I highly recommend this item.

No it's not battery operated at all. The legs and little arms move if you move them by hand

The real one should have a papo sticker that has a model number and a barcode around one of the arms,and a not for children under 3 warning sticker around one of the legs. It also comes with a plastic stand, that the feet fits right into.
